    Please read these Terms of Service carefully before using the AI Fluency platform by Gaussian Mind Trading & Projects (Pty) Ltd, T/A Acalytica.

    1. Agreement to Terms

    These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Gaussian Mind Trading & Projects (Pty) Ltd, T/A Acalytica (CIPC: 2013/107695/07) ("Company", "we", "us", or "our"), a South African registered company.

    By accessing or using our platform at aifluency.acalytica.com ("Platform"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must not access or use the Platform.

    2. Eligibility

    To use this Platform, you must:

    • Be at least 18 years of age
    • Have the legal capacity to enter into a binding contract under South African law
    • Not be barred from using the Platform under any applicable laws
    • Provide accurate, current, and complete information during registration

    By using the Platform, you represent and warrant that you meet these requirements.

    3. Account Registration and Security

    3.1 Account Creation

    You must create an account to access certain features. You agree to provide accurate and complete information and keep this information up to date.

    3.2 Account Security

    • You are responsible for maintaining the confidentiality of your password
    • You are responsible for all activities that occur under your account
    • You must notify us immediately of any unauthorized access or security breach
    • We are not liable for losses caused by unauthorized use of your account

    3.3 Account Termination

    We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or for any other reason at our sole discretion.

    4. Service Description

    AI Fluency Academy provides an online learning platform offering:

    • One shared core of modules, with role-based tracks that draw on them — shared learning content for professionals
    • Practical prompting exercises and AI feedback within the learning experience
    • Learning games and daily challenges with assessment and team participation reporting; current games are listed on the Games page
    • Daily micro-lessons, one-tap daily check-ins, and post-completion action prompts to sustain engagement
    • Behavioural engagement features including streak freeze tokens, colleague activity notifications, and browser tab badges
    • Inline social proof showing teammate progress during lessons
    • Verified certificates and digital badges upon completion, with public profile sharing and QR code verification
    • Community features, discussion forums, prompt library, and direct messaging
    • Simulation Mode — Unlocked upon completing 100% of assigned learning tracks, providing a simulated workspace with sample data for practice scenarios
    • Role-based access control (RBAC) with learner, org admin, and super admin roles
    • Individual workspaces — automatic personal workspace creation for users without an organisational affiliation
    • Progress tracking, department analytics, platform analytics, and organisational dashboards
    • Organisation self-service administration for member management and learning reports
    • Dual-track referral programme with XP rewards and financial commission tracking
    • Smart streak reminders, morning digest emails, and weekly progress summaries
    • Account data export and deletion requests, as described in the Privacy Policy

    We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time without notice.

    5. Platform Access

    AI Fluency Academy is available to employees of organisations with an active subscription and to individual learners. Organisation members are detected via email domain; users without an organisational affiliation are automatically provisioned a personal "Individual" workspace.

    5.1 Eligibility

    • You may be a member of a registered organisation or an individual learner
    • Organisation members should register using their official work email address
    • Individual learners may register with any valid email address and receive a personal workspace
    • Access may be revoked if your employment status changes, your organisation's subscription lapses, or you violate these Terms

    5.2 Access Termination

    Your access to the platform may be terminated if you leave your organisation's employment, your organisation's subscription expires, or you violate these Terms of Service. Upon termination, your account data may be retained for record-keeping purposes.

    6. User Conduct and Obligations

    You agree NOT to:

    • Share your account credentials with others
    • Use the Platform for any illegal or unauthorized purpose
    • Copy, modify, distribute, or reverse engineer any part of the Platform
    • Use automated systems (bots, scrapers) to access the Platform
    • Submit false, misleading, or fraudulent information
    • Harass, abuse, or harm other users
    • Upload viruses, malware, or malicious code
    • Violate any applicable South African laws or regulations
    • Impersonate another person or entity
    • Interfere with the Platform's operation or security
    • Use the Platform to distribute spam or unsolicited communications

    Violation of these rules may result in immediate account termination without refund.

    7. Intellectual Property Rights

    7.1 Our Content

    All content on the Platform, including text, graphics, logos, videos, software, and learning materials ("Our Content"), is owned by Gaussian Mind Trading & Projects (Pty) Ltd, T/A Acalytica, and protected by South African and international copyright, trademark, and intellectual property laws.

    7.2 License to Use

    We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes as permitted by your subscription plan.

    7.3 Your Content

    You retain ownership of content you create on the Platform (prompts, submissions, posts). By submitting content, you grant us a worldwide, royalty-free license to use, display, and distribute your content on the Platform for operational purposes.

    7.4 Certificates and Badges

    You may use earned certificates and badges for professional purposes (LinkedIn, CV). However, you may not modify, forge, or misrepresent your credentials.

    8. Disclaimers and Limitations of Liability

    8.1 "As Is" Service

    THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

    8.2 Educational Purpose & Accreditation Disclaimer

    Our content is for educational purposes only. We make no guarantees about learning outcomes, career advancement, or business results from using the Platform.

    ACCREDITATION DISCLAIMER: AI Fluency Academy does not claim SETA or QCTO accreditation. Platform certificates do not constitute formal qualifications, award NQF credits or establish independently assessed workplace competence. See Learning Methodology for assessment evidence and limitations.

    8.3 Third-Party Services

    The Platform integrates with third-party services (Paystack, AI models). We are not responsible for the availability, accuracy, or security of these services.

    8.4 Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY SOUTH AFRICAN LAW, GAUSSIAN MIND TRADING & PROJECTS (PTY) LTD, T/A ACALYTICA, SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

    OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

    9. Indemnification

    You agree to indemnify, defend, and hold harmless Gaussian Mind Trading & Projects (Pty) Ltd (T/A Acalytica), its officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including legal fees) arising from:

    • Your use or misuse of the Platform
    • Your violation of these Terms
    • Your violation of any third-party rights, including intellectual property rights
    • Content you submit to the Platform

    10. Data Protection and Privacy

    Your use of the Platform is also governed by our Privacy Policy, which describes the information we collect, its use, and how to request access or deletion. By using the Platform, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy.

    11. Governing Law and Dispute Resolution

    11.1 Governing Law

    These Terms are governed by the laws of the Republic of South Africa. The courts of South Africa shall have exclusive jurisdiction over any disputes.

    11.2 Dispute Resolution

    Before initiating formal legal proceedings, you agree to attempt to resolve disputes through good-faith negotiation. If negotiation fails, disputes shall be resolved through arbitration in Johannesburg, South Africa, in accordance with the Arbitration Act, 1965.

    12. Changes to These Terms

    We may modify these Terms at any time. Material changes will be notified via:

    • Email to your registered address
    • Prominent notice on the Platform
    • In-app notification

    Your continued use of the Platform after changes constitutes acceptance of the modified Terms. If you do not agree to changes, you must stop using the Platform and cancel your subscription.

    13. Severability

    If any provision of these Terms is found to be unenforceable or invalid under South African law, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

    14. Entire Agreement

    These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gaussian Mind Trading & Projects (Pty) Ltd (T/A Acalytica) regarding the use of the Platform and supersede all prior agreements and understandings.
